Concessions for BOT projects may be structured either according to a maximum share of turnover for a fixed concession period, or after a minimum concession period for a fixed share of revenue, a combination of both or a minimum concession period. One of the main differences between the type of franchised concession and bot is that, in a franchise, the Authority is at the forefront of the definition of the level of service and is ready to make payments to that effect, while the authority imposes certain basic requirements for the BOT type and may not be directly financially responsible. The Bangkok Mass Transit System Public (BTS), Bangkok`s rail system, is an example of a BOT project. The project was implemented under a 30-year BOT concession contract between the concessionaire and the Bangkok Metropolitan Administration (the municipal government). Under a bot contract (Build-Operate-Transfer), a company – usually a government – grants a private company a concession to finance, build and operate a project. The company manages the project for a fixed period of time (perhaps 20 or 30 years) in order to repay its investment, and then entrusts control of the project to the government. The National Highways Builders` Federation (NHBF) wants developers to be properly compensated, given that the recent revision of the law with regard to axle load parameters, which allow vehicles to carry an increased load, has resulted in a reduction in traffic and, therefore, a loss of revenue for developers. Toll concessions do not provide for payment in the event of an escalation in the basic costs of raw materials such as cement, steel, bitumen and fuel, the project owners add. Escalation is expected to be compensated by the concessionaire for these points and can be determined during the tender phase itself, NHBF said. It is not immediately clear whether the revised MCA has allayed these concerns. A concession gives a concessionaire the long-term right to use all supplies transferred to the concessionaire, including responsibility for operation and certain investments.
